Terms of Service

1. Acceptance of Terms

By accessing or using the Nations Roof website (the "Site"), including by submitting information through the Site, you agree to be bound by these Terms of Service (the "Terms") and our Privacy Policy. If you do not agree to these Terms, do not access or use the Site.

If you access or use the Site on behalf of a company or other legal entity, you represent and warrant that you have authority to bind that entity to these Terms, and references to "you" include that entity.

 

2. About Nations Roof

Nations Roof provides commercial roofing services, including inspections, maintenance, repairs, replacements, and related roofing solutions. Information on the Site is provided for general informational purposes and to facilitate service inquiries and related communications.

 

3. Use of the Site

You agree to use the Site only for lawful purposes and in accordance with these Terms. You may not:

  • Submit false, inaccurate, incomplete, or misleading information.

  • Attempt to interfere with the Site's operation, functionality, performance, or security, or gain unauthorized access to any portion of the Site or related systems.

  • Use the Site to transmit harmful, unlawful, infringing, defamatory, or malicious code, files, or content.

  • Use any robot, spider, scraper, crawler, data-mining tool, or other automated means to access, monitor, copy, or extract content from the Site without Nations Roof's prior written consent.

  • Impersonate any person or entity or misrepresent your identity or affiliation with any person or entity.

  • Use the Site in any manner that could disable, overburden, damage, or impair the Site or interfere with any other party's use of the Site.

Nations Roof reserves the right to suspend, restrict, or terminate access to the Site at any time, without notice, for conduct that Nations Roof believes violates these Terms, is harmful to other users, or may expose Nations Roof to liability, operational disruption, or security risk.

 

4. Service Requests and Communications

Submitting a form, sending an inquiry, or otherwise communicating through the Site does not create a binding agreement for services, a commitment to perform work, or any duty on the part of Nations Roof to provide services.

Service availability, project scope, schedule, pricing, warranty terms, and performance obligations are subject to separate written agreements, proposals, or other written confirmations issued by Nations Roof.

Nations Roof may use the information you submit to respond to your request, administer the Site, evaluate potential services, and provide relevant communications, in each case subject to the Privacy Policy.

Any proposal, scope, schedule, pricing, warranty, or service commitment must be set forth in a separate written agreement, proposal, or other written confirmation from Nations Roof.

 

5. Privacy and Data Use

Your use of the Site is also subject to the Nations Roof Privacy Policy, which describes how information is collected, used, disclosed, and otherwise processed in connection with the Site. By using the Site or submitting information through it, you acknowledge that Nations Roof may process such information in accordance with the Privacy Policy.

If you submit or upload information, documents, photographs, plans, specifications, drawings, or other materials through the Site (collectively, "Submissions"), you represent and warrant that: (a) you have the right to provide those Submissions; (b) the Submissions are accurate to the best of your knowledge; and (c) the Submissions do not violate any law, contract, or third-party right.

Nations Roof may use Submissions to review and respond to your request, administer the Site, evaluate potential services, and perform related business functions. Except as expressly stated in a separate written agreement, Submissions will not be treated as confidential or proprietary.

 

7. No Professional Advice

Content on the Site is provided for general informational purposes only and should not be relied on as technical, engineering, architectural, code-compliance, safety, or roofing specification advice for any particular project or condition.

Site content is not a substitute for project-specific inspections, testing, design review, engineering analysis, code review, manufacturer requirements, or written scope documents. Final recommendations, project requirements, and service terms are determined through formal inspections and written proposals or other written agreements, as applicable.

 

8. Intellectual Property

All content, features, and functionality on the Site, including text, graphics, logos, images, videos, software, layouts, and design elements, are owned by Nations Roof or its licensors and are protected by applicable intellectual property laws.

Subject to these Terms, Nations Roof grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your internal informational and legitimate business purposes only. No other right, title, or license is granted by implication, estoppel, or otherwise. You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit Site content except as expressly authorized in writing by Nations Roof.

The Site may include or rely on third-party tools, services, embedded content, communication platforms, analytics, or links to external websites. Nations Roof does not control and is not responsible for the content, availability, accuracy, security, functionality, or privacy practices of third-party sites or services.

Links to third-party sites or the inclusion of third-party tools do not imply endorsement by Nations Roof. Your use of any third-party site or service is at your own risk and is subject to the terms and policies of the applicable third party.

 

10. Disclaimer of Warranties

THE SITE AND ALL CONTENT, FEATURES, AND SERVICES MADE AVAILABLE THROUGH IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR AVAILABILITY.

To the fullest extent permitted by law, Nations Roof does not warrant that:

  • The Site will be uninterrupted, timely, secure, or error-free.

  • Defects or errors will be corrected.

  • The Site or any content made available through it will be free of viruses or other harmful components.

  • Information on the Site is accurate, complete, reliable, or current at all times.

 

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NATIONS ROOF AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, REVENUE, PROFITS, BUSINESS, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR ACCESS TO, USE OF, INABILITY TO USE, OR RELIANCE ON THE SITE, ANY SITE CONTENT, OR ANY THIRD-PARTY SITES OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

If, notwithstanding the foregoing, Nations Roof is found liable for any claim arising out of or relating to the Site, Nations Roof's total aggregate liability shall not exceed one hundred dollars ($100.00) or the amount paid, if any, by you to use the Site during the twelve (12) months preceding the event giving rise to the claim, whichever is greater.

 

12. Indemnification

You agree to defend, indemnify, and hold harmless Nations Roof and its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees, including reasonable attorney fees, arising out of or relating to:

  • Your violation of these Terms.

  • Your misuse of the Site.

  • Your Submissions.

 

13. Changes to These Terms

Nations Roof may revise these Terms from time to time in its discretion. Updated Terms will be effective when posted to the Site unless a different effective date is stated. Your continued use of the Site after revised Terms are posted constitutes your acceptance of the revised Terms.

 

14. Governing Law and Venue

These Terms are governed by the laws of the State of Alabama, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Mobile County, Alabama, and you consent to the personal jurisdiction and venue of those courts.

 

15. Miscellaneous

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect. Nations Roof's failure to enforce any provision of these Terms is not a waiver of that provision or any other provision. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Nations Roof regarding the Site. You may not assign these Terms without Nations Roof's prior written consent, and Nations Roof may assign these Terms without restriction.
